Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Talarion, Inc., a Delaware corporation ("Talarion," "we," "us"). They govern your access to talarion.com, the Talarion MCP server at mcp.talarion.com, and any related tools or APIs (together, the "Services").

By accessing or using the Services you agree to these Terms. If you don't agree, don't use the Services.

The Services

Talarion provides a knowledge service that helps keep AI systems up to date with current information. The Services are accessed programmatically — primarily via the Model Context Protocol (MCP). Responses are informational and should not be treated as professional, legal, financial, or medical advice.

Accounts and access

Some features require an account. You're responsible for keeping your credentials — including API keys — confidential and for all activity under your account. Notify us promptly if you suspect unauthorized use.

We may suspend or terminate accounts that violate these Terms, at our discretion and without prior notice.

Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
  • Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Services.
  • Circumvent rate limits, authentication, or other technical restrictions.
  • Resell, sublicense, or redistribute Service outputs as a standalone product without our written consent.
  • Interfere with the integrity or performance of the Services or third-party data they rely on.

Your content

"Your Content" means the queries, assertions, and other material you submit to the Services. You retain ownership of Your Content. By submitting it, you grant Talarion a worldwide, royalty-free license to use, store, and process Your Content as needed to operate, improve, and develop the Services — including training and tuning models.

Intellectual property

The Services, their design, underlying technology, and documentation are owned by Talarion and protected by intellectual-property laws. These Terms don't grant you any right to our trademarks, logos, or branding.

You may use the factual content returned by the Services in your own products and workflows. That license is non-exclusive and doesn't extend to the Services themselves.

Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Talarion disclaims all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make reasonable efforts to return accurate, current information, but we don't guarantee that any response is complete, error-free, or suitable for your particular use case. You're responsible for evaluating and verifying outputs before relying on them.

Limitation of liability

To the maximum extent permitted by law, Talarion and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of the Services, regardless of the theory of liability.

Our total aggregate liability for any claim arising under these Terms will not exceed the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

Indemnification

You agree to indemnify and hold harmless Talarion and its officers, directors, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party right.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Changes to these Terms

We may revise these Terms at any time. The "Effective" date at the top reflects the latest version. For material changes we'll make a reasonable effort to notify you. Continued use of the Services after a change takes effect means you accept the revised Terms.
